TERMS & CONDITIONS

1. Qualifying Persons:

1.1. Aviationwinner (‘Aviationwinner’, 'Promoter', 'our(s)') operate competitions – prize draw competitions ('draws') resulting in the allocation of prizes in accordance with these Terms and Conditions at selected retail locations and events and on the website www.aviationwinner.com (the 'Website') - (the 'Competition(s)').

1.2. The Competitions are open to all persons aged 18 and over and the age of majority in their country of residence excluding the Promoter's employees or members of their immediate family, agents or any other person who is connected with the creation or administration of our Competitions.

2. Legal Undertaking:

2.1. By entering a Competition, the entrant ('Entrant', 'you', 'your(s)') will be deemed to have legal capacity to do so, you will have read and understood these Terms and Conditions and you will be bound by them and by any other requirements set out in any related promotional material.

2.2. These Competitions are governed by English Law and any matters relating to the Competition will be resolved under English Law and the Courts of England shall have exclusive jurisdiction.

2.3. In the event that you participate in a Competition online via the Website, and by accepting these Terms and Conditions you confirm that you are not breaching any laws in your country of residence regarding the legality of entering our Competitions. The Promoter will not be held responsible for any Entrant entering any of our Competitions unlawfully. If in any doubt you should immediately leave the Website and check with the relevant authorities in your country.

3. Competition Entry:

3.1. These Competitions may be entered online via the Website www.aviationwinner.com or by post to the registered address. There are various categories of Competitions: Aircraft Competitions, Flight Training Competitions, Flying Experiencer Competitions, Engine Competitions, Avionics Competitions and Accessories Competitions. One or more Competitions may be operated at the same time and each Competition will have specific prize options.

3.2. Availability and pricing of Competitions and tickets is at the discretion of the Promoter and will be specified at the point of sale on the Website. If the minimum required number of tickets for any of the prize draws fail to sell during the promotion period, then entrants for that promotion period will have their entires rolled over to the next promotion period. If the promotor cancels any of the competitions for any reason then refunds may be offered less the ticket service charge.

3.3. Your Aviationwinner Account(s)

In order to enter a Competition, you will need to register an account with us or enter via a postal entry.

(a) You can register an account online at www.aviationwinner.com.

(i) To register an account online you will be asked to provide an e-mail address or sign in via a social media account,

such as Facebook, Apple, Twitter or Google (‘Social Media Account’)

(b) Please note that your e-mail address or Social Media Account will also be the username that you use to log into your

account. Each account can only have one username attributed to it at any given time (“Aviationwinner Account").

Therefore, you cannot attribute multiple e-mail addresses, or Social Media Accounts to your Aviationwinner Account. For

example:

(i) You cannot have an e-mail address and a Social Media Account attributed to your Aviationwinner Account.

(ii) You cannot have two or more e-mail addresses attributed to your Aviationwinner Account.

(c) You can however, change your username for your Aviationwinner Account by logging into your Aviationwinner Account.

For example, you can create your Aviationwinner Account using one e-mail address and at a later date change your

username for your Aviationwinner Account to another e-mail address. However, if you create multiple accounts using

different e-mail addresses or Social Media Accounts, each username will be treated as a separate Aviationwinner

Account.

3.4. When playing a Competition via a free postal entry (postal entries are limited to one entry per competition month):

(a) select the Competition you wish to enter and send your entry to: Aviationwinner, 79 Tonbridge Road, Hildenborough,

Kent, TN11 9BH, providing your full name, postal address and contact telephone number.

(b) Entries must be sent on a postcard or on or within an envelope. Entries received on anything other than a postcard or

envelope will not be accepted. In the case of multiple entries received in a single envelope or postcard, only one entry

will be entered into the promotion.

(c) Entries sent by post must be received at the relevant postal address specified for entries by the closing date and time for receipt of entries. Postal entries without correct and sufficient postage paid will be invalid and will not be considered.

Personal and hand deliveries will not be accepted. ('Postal Entries’).

3.5. When playing a Competition online via the Website, follow the on-screen instructions to:

(a) select the Competition(s) you wish to enter and choose your tickets.

(b)purchase your Ticket(s), provide your contact and payment details. You will need to check your details carefully and tick

the declaration at checkout, confirming you have read and understood the Competition Terms and Conditions;

(c) once your payment has cleared, we will e-mail you to confirm your entry into the Competition(s). Please note that when

entering online you will not be deemed entered into the Competition until we confirm your Ticket(s) order back to you by

e-mail. ('Website Entries' with ', referred to as 'Entr(y)(ies)')

('Website Entries' together with ‘Postal Entries', referred to as 'Entr(y)(ies)')

3.6 The Promoter reserves the right to refuse or disqualify any incomplete Entries if it has reasonable grounds for believing that an Entrant has contravened any of these Terms and Conditions.

3.7 To the extent permitted by applicable law, all Entries become our property and will not be returned.

4. Promotion Periods:

4.1. Each Competition will run for a specified period. Please see each Competition for details of start and end times and dates ('Promotion Period(s)').

5. Competition Judgment:

5.1. Aircraft Competitions, Flight Training Competitions, Flying Experience Competitions,  Avionics Competitions, Engine Competitions and Accessory Competitions: The prize draw will be carried out using a random number generator with all of the tickets for the particular competition entered. Postal entries will be given their own unique ticket number allowing them to be added to and included with the online entries for the draw. The draw will be overseen by the appointed impartial Promoter’s judge and solicitor.

5.2 The Prize Draw Winner, Winner(s) are all referred to as 'Winner(s)'.

5.3 The Promoter will attempt to contact Winner(s) using the telephone numbers and e-mail address provided at the time of Entry (or as subsequently updated) and held securely in our database. It is the Entrant's sole responsibility to check and update these details. If for any reason they are taken down incorrectly, the Promoter will not be held responsible. Entrants must carefully check their contact details have been recorded correctly.

5.4. Time critical: Where the Prize must be taken up within 1 month of the close date of the competition, the competition will be considered ‘time critical’. As the Winner(s) needs to be found before the time to take up the prize passes, the interaction information will indicate the date(s) when entrants must be contactable and the Promoter will try to contact the Winner(s) on the phone number (or other method of contact (if appropriate)) provided, calling three times in a three-hour daytime period or as indicated in the interaction information.

5.5. Time sensitive: Where the Prize must be taken up by a date which is more than 1 month but less than 6 months after the close date of the competition, unless otherwise stated in the interaction information the Promoter will try to contact the Winner(s) on the phone number (or other method of contact (if appropriate)) they provided over a two week period or as indicated in the interaction information.

5.6 If for any reason the Promoter is unable to contact the Winner(s) within the time periods set out in clauses 5.4 and 5.5 (which may be extended at the sole discretion of the Promoter) of the end of a Competition or the Winner(s) fails to confirm acceptance of the prize or the Winner(s) is/are disqualified as a result of contravening any of these Terms and Conditions, the Winner may forfeit the prize. Another draw will take place and it will be awarded to the alternate Winner(s). The original Winner(s) will have no further claims against the Promoter.

5.7 The Promoter reserves the right at its sole discretion to extend the closing date of any competition, if for any reason any aspect of the competition is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Competition. The Promoter may in its sole discretion cancel, terminate, modify or suspend a Competition, or invalidate any affected entries. In the event that the Promoter closes a Competition early, the Winner(s) may be selected from all valid and eligible Entries received by the Promoter prior to the date of closure, except that the Promoter reserves the right, at its sole discretion, to close a Competition early without selecting a Winner. In the event that a Competition is closed without selecting a Winner, the Promoter will give all entrants Credit to enable them to replay equivalent tickets in a subsequent competition.

5.8 All Entrants are automatically entered onto the Promoter's database for the purpose of conveying information as to the status of their Competition, as well as any future Promotions or Competitions offered by the Promoter.

6. Winner's(s’) Details:

6.1. The Winner(s) will be required to send a copy of their passport to the Promoter to confirm their identity, age and also to prove that if the purchase was made by credit card that the card was legally theirs or that they had authorisation to use it before any prize will be paid or delivered. Any failure to meet these obligations may result in the Winner(s) being disqualified and the Promoter choosing an alternate winner.

6.2. All Winner(s) will also be required to provide photographs and/or pose for photographs and videos, which may be used in future marketing and public relations by the Promoter in connection with the Competition and in identifying them as a winner of a Competition.

6.3. Following receipt and verification of the details requested above by the Promoter, the Winner(s) will be contacted in order to make arrangements for delivery of the prize. At this point the Winner(s) must choose between the prizes available (as detailed in the Competition prize information on the Website) and notify the Promoter of their choice in writing.

7. Competition Prizes:

7.1. Aircraft Competitions: Aircraft Competitions are comprised of many different aircraft and aircraft kits. For the avoidance of doubt, there will be only one aircraft or aircraft kit awarded for each Competition period ('Prize') and not one of each aircraft listed. Please also note the following:

(a) During the course of an Aircraft Competition, if due to circumstances beyond the Promoter's control, the Promoter is

unable to provide the stated Prize, the Promoter reserves the right to award a selection of substitute alternate prizes of

equal or greater value.

(b) If the Winner(s) would like to take an aircraft or aircraft kit, an order will be placed by the Promoter. Please note that if the Winner(s) decides to do this, delivery time will be determined by the aircraft manufacturer may take up to 12 months or more for certain aircraft which will be ordered in the specification as advertised. Aircraft kits are supplied directly from the manufacturer in the standard kit build form and will not include other accessories such as engine, propeller or avionics. Bespoke options and upgrades can be added at the Winner(s) request but must be paid for by the Winner(s) in advance.

(c) In the UK the Prize will be delivered with UK VAT paid. In the EU the Prize will be delivered with UK VAT paid but any

further costs (additional VAT/taxes/import duties/registration costs due in the destination/winners country) will be the

responsibility of the Winner(s).

In all other countries the Prize will be shipped (net of all taxes) to the nearest port and any applicable import duties,

registration costs, or any further taxes or duties of any nature due in the destination country will be the responsibility of

the Winner(s). The Promoter reserves the right not to deliver to certain countries. Please note that all our aircraft are

supplied in the UK specification and therefore if exported may not be to the specification of the aviation authority in the

destination country. It is the Winner's(s’) responsibility to check this and choose an alternative or take a cash alternative,

if appropriate.

For the avoidance of doubt, the maximum value that the Promoter will be liable to pay for towards any prize is the

manufacturers UK RRP (or local currency equivalent) of the prize as advertised on our website. The Promoter will only

transact with manufacturer recommended principal dealers. The Promoter’s liability will end once an order has been

placed with the manufacturer.

(d)The aircraft competition may offer a second hand aircraft as a prize. If the winner(s) would like to take the aircraft it will be supplied with no warranty and when it has been delivered this will be the end of the Promoter's liability. The prize may also consist of a conversion course which will cover the minimum course footprint. If the winner(s) do not complete the conversion training during this period then any further training costs will be at their expense. The Promoter cannot guarantee the winner(s) will pass the conversion course and the Promoter's liability will end once the aircraft has been delivered.

7.2. Flight Training Competitions: Flight Training Competitions are comprised of many different licences, ratings and hour building packages. For the avoidance of doubt, there will be only one licence, rating or hour building package awarded for each Flying Training Competition period and not one of each licence, rating or hour building package listed.

Please also note the following:

(a) During the course of a Flight Training Competition, if due to circumstances beyond the Promoter's control, the Promoter is unable to provide the stated Prize, the Promoter reserves the right to award a selection of substitute alternate prizes of equal or greater value.

(b) If the Winner(s) would like to accept the flight training, then the Winner(s) will have the option to choose from a variety of Training providers within the UK or their country of residence up to the value of the equivalent UK course. For the

avoidance of doubt each course will have a monetary value which will be converted into the winners local currency at the

time of the competition closure. This will be the limit of the Promoter’s liability. If the winner has the appropriate licence

for another country other than their country of residence (for example a United States Federal Aviation Administration

(FAA) licence but lives in the UK, they can take an option to complete the course at an FAA training facility) they may

complete the course in the country where their existing licence is held. For the avoidance of doubt the Promoter will only

pay the UK or equivalent UK course value in the winners chosen country and is not liable for any travel or

accommodation costs.

(c) The winner may need to obtain an appropriate medical certificate prior to commencing flight training, this will be at the

Winner’s(s’) expense. If the winner is unable to obtain the required level of medical certificate, then an alternate prize of

equal or greater value will be offered by the Promoter. If the winner has an expired licence or medical, then it is beholden

upon them to revalidate the appropriate licence or medical prior to commencing training.

(d) If the prize is a particular ‘add on’ rating that requires the winner to hold a particular licence then, it is beholden upon the winner to ensure they hold the appropriate licence.

(e) The Winner(s) may need to demonstrate a particular level of ability and or aptitude to successfully complete a flight

training course. The promotor does not guarantee that any course the winner embarks upon will lead to a successful

conclusion and or result in that licence or rating being achieved. The Promotor will not be liable if the winner fails to

demonstrate the required level of ability or aptitude required by the training course.

(f) In all cases the Promoters liability ends once the winner has accepted the Prize.

7.3 Engine Competitions:

Engine Competitions are comprised of many different engine types. For the avoidance of doubt, there will

be only one Engine awarded for each Competition period and not one of each Engine listed.

Please also note the following:

(a) During the course of an Engine Competition, if due to circumstances beyond the Promoter's control, the Promoter is

unable to provide the stated Prize, the Promoter reserves the right to award a selection of substitute alternate prizes of

equal or greater value.

(b) If the Winner(s) would like to accept the Engine, then an order will be placed by the Promoter. Please note that if the

winner decides to do this, delivery time will be determined by the engine manufacturer and may take up to 12 months or

more for certain engines which will be ordered in the specification as advertised. Bespoke options and upgrades may be

added at the Winner's(s’) request but must be paid for by the Winner(s) in advance.

(c) In the UK the Prize will be delivered with UK VAT paid. In the EU the First Prize will be delivered with UK VAT paid but

any further costs (additional VAT/ taxes/import duties/registration costs due in the destination/ winners country) will be

the responsibility of the Winner(s). In all other countries the Prize will be shipped (net of all taxes) to the nearest port and

any applicable import duties, registration costs, or any further taxes or duties of any nature due in the destination country

will be the responsibility of the Winner(s). The Promoter reserves the right not to deliver to certain countries. Please note

that all of the Engines are supplied in the specification as advertised and therefore if exported may not be to the

specification of the aviation authority in the destination country. It is the Winner's(s’) responsibility to check this and

choose an alternative or take a cash alternative if appropriate.

(d) For the avoidance of doubt, the maximum value that The Promoter will be liable to pay for or towards any prize is the

manufacturers UK RRP (or local currency equivalent) of the prize as advertised on our website. The Promoter will only

transact with manufacturer recommended principal dealers.

(e) The promoters liability will end once an order has been placed with the manufacturer. Once the order has been placed

delivery will become the responsibility of the manufacturer/distributor and the winner should liaise directly with them.

7.4 Avionics Competitions: 

 

Avionics Competitions are comprised of many different Avionic suites. For the avoidance of doubt, there

will be only one Avionics suite awarded for each Competition period and not one of each avionics suite listed.

Please also note the following:

(a) During the course of a Avionics Competitions, if due to circumstances beyond the Promoter's control, the Promoter is

unable to provide the stated First Prize, the Promoter reserves the right to award a selection of substitute alternate

prizes of equal or greater value.

(b) If the Winner(s) would like to accept the avionics suite then an order will be placed by the Promoter. Please note that if

the Winner(s) decides to do this, delivery time will be determined by the avionics manufacturer may take up to 12

months or more for certain aircraft which will be ordered in the specification as advertised. Bespoke options and

upgrades may be added at the Winner's(s’) request but must be paid for by the Winner(s) in advance.

(c) In the UK the Prize will be delivered with UK VAT paid. In the EU the First Prize will be delivered with UK VAT paid but

any further costs (additional VAT/ taxes/import duties/registration costs due in the destination/winners country) will be the

responsibility of the Winner(s). In all other countries the Prize will be shipped (net of all taxes) to the nearest port and

any applicable import duties, registration costs, or any further taxes or duties of any nature due in the destination country

will be the responsibility of the Winner(s). The Promoter reserves the right not to deliver to certain countries. Please note

Accessory Competitions are comprised of many different accessory packages. For the avoidance of

doubt, there will be only one accessory package awarded for each Competition period and not one of each accessory package listed. Please also note the following:

(a) During the course of an accessory Competition, if due to circumstances beyond the Promoter's control, the Promoter is

unable to provide the stated First Prize, the Promoter reserves the right to award a selection of substitute alternate prizes

of equal or greater value.

(b) If the Winner(s) would like to accept the accessory package then an order will be placed by the Promoter. Please note

that if the Winner(s) decides to do this, delivery time will be determined by the aircraft manufacturer may take up to 12

months or more for certain aircraft which will be ordered in the specification as advertised. Bespoke options and

upgrades can be added at the Winner's(s’) request but must be paid for by the Winner(s) in advance.

(c) In the UK the Prize will be delivered with UK VAT paid. In the EU the First Prize will be delivered with UK VAT paid but

any further costs (additional VAT/taxes/import duties/registration costs due in the destination/winners country) will be the

responsibility of the Winner(s). In all other countries the Prize will be shipped (net of all taxes) to the nearest port and any

applicable import duties, registration costs, or any further taxes or duties of any nature due in the destination country will

(d)The Promoter’s liability will end once an order has been placed with the manufacturer. Once the order has been placed

delivery will become the responsibility of the manufacturer/distributor and the winner should liaise directly with them.

7.6. Flying Experience Competitions: Flying Experience Competitions are comprised of many different experience packages. For the avoidance of doubt, there will be only one experience package awarded for each Flying Experience Competition period and not one of each licence, rating or hour building package listed.

Please also note the following:

(a) During the course of a Flying Experience Competition, if due to circumstances beyond the Promoter's control, the Promoter is unable to provide the stated Prize, the Promoter reserves the right to award a selection of substitute alternate prizes of equal or greater value.

(b) If the Winner(s) would like to accept the flying experience, then the Winner(s) may have the option to choose from a variety of experience providers within the UK.

For the avoidance of doubt each experience will have a monetary value at the time of the competition closure. This will be the limit of the Promoter’s liability.

(c) The winner may need to obtain an appropriate medical certificate prior to commencing the flying experience, this will be at the Winner’s(s’) expense. If the winner is unable to obtain the required level of medical certificate, then an alternate prize of equal or greater value will be offered by the Promoter.

(d) In all cases the Promoters liability ends once the winner has accepted the Prize.

8. Winner’s(s') Personal Data:

8.1. Acceptance of the prize by the Winner(s) will mean they are required to have their photo and video taken by the Promoter for promotional purposes (Public Relations and Marketing), both immediately after their win and in the future for use in accordance with clause 6.2, unless prohibited by law.

8.2. By entering a Competition, you agree to the use of your name, address, and/or photograph or other likeness, as well as your appearance at publicity events without any additional compensation (save for reasonable travel expenses) and as required by the Promoter if you are declared a Winner(s).

 

9. Limits of Liability:

9.1. The Promoter makes no representations or warranties as to the quality/suitability of any of the goods or services offered as prizes. Except for liability for death or personal injury caused by the negligence of the Promoter, the Promoter shall not be liable for any loss suffered or sustained to person or property including, but not limited to, consequential (including economic) loss by reason of any act or omission by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods by any person to the Winner(s) and, where applicable, to any family/persons accompanying the Winner(s), or in connection with any of the Competitions promoted by the Promoter.

10. Electronic Communications:

10.1 No responsibility will be accepted for failed, partial or garbled computer transmissions, for any computer, telephone, cable, network, electronic or internet hardware or software malfunctions, failures, connections, availability, for the acts or omissions of any service provider, internet accessibility or availability or for traffic congestion or unauthorised human act, including any errors or mistakes. The Promoter shall use its best endeavours to award the prize for a Competition to the correct Entrant. If due to reasons of hardware, software or other computer related failure, or due to human error the prize is awarded incorrectly, the Promoter reserves the right to reclaim the Competition prize and award it to the correct Entrant, at its sole discretion and without admission of liability.

10.2 The Promoter reserves the right at its sole discretion to extend the closing date of any competition, if for any reason any aspect of the competition is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Competition. 10.3 The Promoter shall not be liable for any economic or other consequential loss suffered or sustained to any persons to whom an award has been incorrectly made, and no compensation shall be due. The Promoter shall use its best endeavours to ensure that the software and website(s) used to operate its Competitions perform correctly and accurately across the latest versions of popular internet, tablet and mobile browsers. For the avoidance of doubt, only the ticket recorded in our systems shall be entered into the relevant Competition and the Promoter shall not be held liable for any competition entries that occur as a result of malfunctioning software or other event. Competition entries may be checked / confirmed at any time by accessing your account at www.planewinner.com or with reference to e-mailed tickets.

11. Data Protection Notice:

11.1. Any Information and data ("personal data") that you supply to the Promoter or authorise the Promoter to obtain from a third party, for example, a credit card company, will be used by the Promoter to administer the Competition and fulfil prizes where applicable. In order to process, record and use your personal data the Promoter may disclose it to:

(i) any credit card company whose name you give;

(ii) any person to whom the Promoter proposes to transfer any of the Promoter's rights and/or responsibilities under any agreement the Promoter may have with you;

(iii) any person to whom the Promoter proposes to transfer its business or any part of it;

(iv) comply with any legal or regulatory requirement of the Promoter in any country; and (v) prevent, detect or prosecute

fraud and other crime. In order to process, use, record and disclose your personal data the Promoter may need to transfer such information outside the United Kingdom, in which event the Promoter is responsible for ensuring that your personal data continues to be adequately protected during the course of such transfer.

12. Privacy:

12.1. Personal data which is provided by you when you enter a competition or prize draw will be held by the Promoter and may be used by the Promoter, prize providers, suppliers and contractors for the purposes of administering and fulfilling the competition or prize draw. You agree that this includes without limitation that we may contact you if there is an issue with the interactive service. Further details of how any personal data will be used are set out below and the Promoter’s privacy policy at www.planewinner.com/privacy and you agree to this use of your personal data when you participate in our interactive services.

12.2. The Promoter and/or the prize provider may send personal data of participants to an interactive service (and where applicable, companion(s) of a winner) to third parties outside the European Economic Area, for the purposes of administering the interactive service and by entering you agree to such transfer for these purposes.

13. General:

13.1 Please note that by making an entry, vote or poll you are consenting to us starting the interactive service immediately and any rights you may have to withdraw from or cancel your purchase (including but not limited to under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013) will be lost because the performance of our services is simultaneous or begins immediately once your purchase is completed.

13.3 If you have a comment, query or complaint about any interactivity provided by the Promoter you may register it with the Promoter’s Customer Support which can be contacted by email at help@planewinner.com. You will need to provide some or all of the following information:

(a) Your name

(b) Your e-mail address

(c) The IP address of your computer

(d) If possible, your internet service provider

(e) The date(s) and time(s) when you experienced problems

(f) The nature of the problem you experienced

(g) A contact telephone number you can be reached on, if necessary

Queries will be addressed as soon as possible.

13.4 If you require any information to be provided in an alternative format for accessibility reasons, we will be happy to discuss your requirements and endeavour to provide a suitable alternative.

 

13.5 For a hard copy of these terms and conditions please contact the Promoter’s Customer Support as set out above or send a stamped addressed envelope to the Promoter's address below. If you would like interaction information relating to a specific interactive event, then include the name of the specific interactivity in your application.
